Sales and Use Tax Nexus

States have become more aggressive in claiming a seller has substantial nexus for sales and use tax purposes.  Per the October 2008 issue of the Journal of Accountancy you should:

  1.  Review "
physical presence" law.
  2.  Know where property is located.
  3.  Know the whereabouts and activities of employees and representatives.
  4.  Examine the nature of transactions and relationships in the state.
  5.  Take into account multi state operations and mobile customers.
  6.  Always ask questions.

Call your accountant before your year end to discuss activities in new states.
